This course is available on the Executive Master of Laws (ELLM). This course is not available as an outside option.
Available to Executive LLM students only. This course will be offered on the Executive LLM during the four year degree period. The Law School will not offer all Executive LLM courses every year, although some of the more popular courses may be offered in each year, or more than once each year. Course content
This course is concerned with the principles and policies underlying the legal treatment of corporate bankruptcy. The impact of these procedures and approaches on third parties, for example corporate groups, secured and unsecured creditors, directors and employees, is also considered. Topics include: Secured creditors; The distributional order of priority in corporate bankruptcy; Setting aside transactions; Quasi-security devices for the unsecured creditor; The problem of corporate groups; Company directors in troubled times; Employees in distress and European and international recognition in corporate bankruptcy.
Teaching
24-26 hours of contact time.
Formative coursework
All students are expected to produce one 2,000 word formative essay during the course.

A full Reading List will be distributed during the course. The recommended text is V. Finch and D.Milman, Corporate Insolvency Law: Perspectives and Principles (Cambridge University Press, 2017) (3rd edition).
